Constitution of the Freedom Alliance
Preamble
1. Recognizing the need the ensuring of freedom, peace, tranquility and justice throughout Nation States, and also recognizing the necessarily of banding together in order to achieve this common goal, we the members of the Freedom Alliance establish this Constitution.
Section 1: Rights of Member States
1. As member states of the Freedom Alliance, every member has the right to call upon the Freedom Alliance's forces for help in times of region-crashing.
2. To take part in the Presidential election.
3. To participate in the Freedom Alliance board, including access to any and all areas which are restricted to members, as long as they do not have additional restrictions.
4. To run for President or other office within the Freedom Alliance.
5. To resign from the Freedom Alliance.
6. To bring charges against the president or other Freedom Alliance officials as well as members.
Section 2: Duties of Member States
1. As member states of the Freedom Alliance, members must be available to take part in military operations every so often, preferably more. If a member genuinely objects to the operation, taking a position of non-involvement is acceptable.
2. To refrain from flaming other Freedom Alliance members, or spamming on areas not appointed for such pursuits on the Freedom Alliance board.
3. Failure to abide by these rules can result in the immediate expulsion of the violation member at the discretion of the president or other duly appointed official.
4. Failure to abide by the rules of the 4th section will also result in expulsion after being tried and if found guilty.
Section 3: New Members
1. In order to join the Freedom Alliance you must register for the Freedom Alliance board.
2. Post an application in the Applications to join the Freedom Alliance (http://freedomalliance.proboards19.com/index.cgi?board=apply) area.
3. In the foresaid post they must include their Nationstates nation's name, their reason for joining the Freedom Alliance, if they are a member of any interregional organization, whether they have participated in any region crashing, and who their allies are. If there is a necessity for secrecy they shall explain that reason to the president or a duly approved official handling the application and send the information through private message on the board or telegram on Nation States.
4. They will then be approved or disapproved by the president or a duly appointed official.
Section 4: High Crimes against the Freedom Alliance
1. Any member accused of committing the following crimes, is subject to immediate trial, and if found guilty, expulsion.
2. Spying, this is defined as giving sensitive information to enemy nations, alliances, or regions, unless it is with prior knowledge or consent of the Freedom Alliance president or appropriate cabinet member(s), whichever is applicable
3. Treason, which is defined as helping enemy nations, regions, or alliances through actively garnering support for use in active resistance against the Freedom Alliance or it's allies for an enemy nation, region, or alliance by encouragement of others to resist FA forces, or directly helping an enemy nation, region, or alliance, specifically, but not limited to endorsements. Objecting to military actions, and not helping with them for that reason does not fall under this category.
4. Disinformation, giving false information about yourself, or nations which you know about. You are not compelled to speak if not asked, but you may not give directly false information.
5. Multying, which is defined as creating multiple nations for the express purpose of double-voting in and/or rigging Freedom Alliance elections. Owning multiple nations in the Freedom Alliance is allowed, but must be told to the leadership beforehand.
Section 5: The Legislative Branch
1. All Legislative powers herein granted are vested in the Parliament of the Freedom Alliance
2. Freedom Alliance Parliament members are elected by the member regions of the Freedom Alliance with terms decided open by the region itself, and the actual election is to be held by the region that is to send the members to Parliament.
3. There shall also be three members of Parliament or a number of additional members equal to 1/20 of the members of parliament elected by regions (whichever is greater) elected by every member of the Freedom Alliance; they shall have terms of 3 weeks.
4. There shall be an elected head of Parliament who's election takes place every 6 weeks, he/she will be elected from among the current members of Parliament, and shall serve the full six weeks. Though if his/her region votes him out of office his/her tenure in Parliament ends as soon as the 6 weeks are up, during that time the new representative of the region will also serve in Parliament.
5. Parliament shall have the power to pass laws by a simple majority.
6. To amend the constitution.
7. To impeach the president, vice-president, and members of the judicial department, in such cases, accusations are sent to the head of Parliament.
8. To conduct investigations of members of the judicial department.
9. To Accept regions into the Freedom Alliance by a 2/3 vote.
10. Can override presidential veto by a 2/3 vote.
11. Can change executive procedures not stated in the constitution by passing laws.
12. Can change judicial procedures not stated in the constitution by passing laws.
13. Approves Presidential appointments to cabinet and judicial branch by a simple majority.
Section 6: Executive Branch
1. All Executive powers herein granted are vested in the President and Vice President of the Freedom Alliance, and may be delegated to cabinet members appointed by the President and approved by Parliament.
2. The President shall have the power to Command the military.
3. Accept new member nations (but not regions).
4. Command the intelligence department.
5. Manage internal affairs.
6. Manage diplomacy.
7. Pass bills which last for a period of four days unless approved by a majority in parliament.
8. Veto bills passed by Parliament when they are passed.
9. Appoints the judicial branch members, which are approved by Parliament.
10. The Vice President is given the power to assist the President and takes over the presidency in case of resignation, impeachment, or inability to log on for extended periods. This last until the next election (which occur every 6 weeks) or in the case of the third condition only, until the president is available again.
Section 7: Judicial Branch
1. All Judicial powers granted herein are vested in the Judicial Branch of the Freedom Alliance.
2. The Judicial Branch has the power to try members excluding the President, Vice President, or Judicial Branch members through this method:
1a. The accusing Freedom Alliance member submits his/her accusation to the head of the Judicial Department (the Head Justice) along with any information backing the accusation up.
2a. The Head Justice decides if the accusation has merit after notifying and discussing it with the other judicial department members. If there is merit, the Head Justice begins an investigation along with the other members of the Judicial Department.
3a. The accused is then given a public trial before which he/she is private messaged and telegrammed with the charges, evidence supporting it (including witnesses), and a link to the trial thread. After 48 hours, unless the accused has not been online, the member's guilt is put to a vote with 2/3 of members voting convicting.
4a. If the accused is found guilty he/she receives penalties decided upon by the Head Justice, depending on the severity of the crime.
5a. If found innocent the accused cannot be tried again for the same crime.
3. Decide the constitutionality of laws, legislative or executive by this method:
1b. The constitutionality is questioned by a member, and that question is private messaged to the head of the Head Justice.
2b. The Head Justice discusses it with the rest of the Judicial Branch, and then decides if there is any merit to the question of constitutionality.
3b. If there is merit then a full discussion takes place on the constitutionality.
4b. After a 48 hour discussion period a vote takes place on the constitutionality of the law, and if it is found unconstitutional it is rendered null.
5b. No matter if it is found unconstitutional or not the Head Justice writes an opinion based on the decision of the Judicial Branch as to why it is or is not unconstitutional for use in future cases.
6b. If a member is tried and a question of constitutionality comes up during the trial, it is halted till the constitutionality is resolved. If the law under which the member is tried under is found unconstitutional then the charges are dismissed if it is the only charge.
4. The Judicial Branch conducts the investigation of the Vice President and President as well as normal members, even though they are tried by Parliament.
5. The Judicial Branch can force Parliament to vote on bills that have been purposed but not voted upon; this power is exercised if and when a majority of Judicial Branch members agree to its application.
Section 8: Amendments
1. To pass amendments, the Amendment is purposed to the whole of Parliament.
2. Parliament votes on the Amendment with 2/3 of the voting members of Parliament's approval required.
3. If successful it is debated by all members for 48 hours, and then put to a full vote with ¾ of all voting members required.
4. If successful it is added to the constitution, successful amendments replace any and all parts of the constitution they conflict with.
5. An Amendment can not declared unconstitutional, nor can it be recalled. It can only be overwritten by another Amendment.
Section 9: Ratification
1. This constitution shall be ratified and made the official law of the Freedom Alliance if:
2. 2/3 of Parliament approves it and,
3. ¾ of all voting members approve it.
